TRADEMARK ASSIGNMENT: Trademark Assignment or Transfer is the process of transferring the ownership of a trademark from one party to another. Here is the step-by-step process for transferring a trademark in India:
1. Prepare an agreement: Both the assignor (current owner) and the assignee (new owner) should prepare a trademark assignment agreement, which should include details regarding the trademark, the parties involved, and the terms and conditions of the transfer.
2. Execute the agreement: Both parties must sign the agreement, and it should be properly stamped and executed as per Indian Stamp Act.
3. File the transfer application: The assignee should file an application for transfer with the Trademark Registry in India in the prescribed Form TM-P. The application should be accompanied by the original trademark registration certificate.
4. Publish the transfer in the Trademark Journal: The Registrar will first examine the application before publishing it in the Trademark Journal. Once published, the public has an opportunity to object to the transfer if they believe it will cause confusion or is likely to deceive them. If no objections are raised within three months, the Registrar will transfer the trademark.
5. Registration of transfer: Once approved by the Registrar, the assignee will receive a new registration certificate with their name as the new owner of the trademark.
